Alabama AED Law - Senate Bill 5 (SB 5)

The State of Alabama created an AED Law on providing for the use and standards for use of an automated external defibrillator (AED).  The Alabama AED Law requirements are the following:

"(a) A person or entity that acquires an AED shall ensure all of the following:

  1. That expected defibrillator users receive appropriate training in an American Heart Association, American Red Cross, or other nationally recognized cardiopulmonary resuscitation (CPR) course and AED, or an equivalent nationally recognized course.
  2. That the defibrillator is maintained and tested according to the manufacturer's operational guidelines.
  3. That there is involvement of a licensed physician or medical authority in the site's AED program to ensure compliance with training, notification, and maintenance.
  4. That any person who renders emergency care or treatment of a person in cardiac arrest by using an AED activates the emergency medical services system as soon as possible.
  5. That each manufacturer, wholesale supplier, or retailer of an AED notifies purchasers of AED's intended for use in the State of Alabama of the requirements of this section.

(b) A person or entity who acquires an automated external defibrillator shall notify the local emergency communications center or dispatch center of the existing location and type of AED.

(c) This section shall not apply to an individual using an AED in an emergency setting if that individual is acting as a good samaritan pursuant to Section 6-5-332, Code of Alabama 1975."

By complying with the requirements of the Alabama AED Law, your organization is protecting itself from liability.  Once your organization has received the AED, your organization will need to notify the local emergency response center about your AED.  Also, simple tasks of having yourself and your staff trained in CPR and how to utilize an AED and properly maintaining the AED by replacing the pads and batteries per the manufacture's guidelines can keep your organization compliant with the state law and will permit your organization the opportunity to attempt to save a life when the time comes.

Alabama Good Samaritan Law - House Bill 68 (HB 68)

The State of Alabama's Good Samaritan Law provides immunity to trained and non-trained responders during an emergency.  The Good Samaritan Law has been enacted to protect persons who in good faith aid a victim during an emergency from being liable for the loss of the victim or injury to the victim.  The Alabama Good Samaritan law states the following:

"A person or entity, who in good faith and without compensation renders emergency care or treatment to a person suffering or appearing to suffer from cardiac arrest, which may include the use of an automated external defibrillator, shall be immune from civil liability for any personal injury as a result of care or treatment or as a result of any act or failure to act in providing or arranging further medical treatment where the person acts as an ordinary prudent person would have acted under the same or similar circumstances, except damages that may result for the gross negligence of the person rendering emergency care."

Alabama School AED Law - Senate Bill 306 (SB 306)

The State of Alabama has recently issued an AED Law that requires public schools (K-12) to have an AED in each school.  Since Sudden Cardiac Arrest can happen at any time, any where, to anyone, schools are having to develop AED Programs to have AEDs available and to staff trained in CPR to assist victims of Sudden Cardiac Arrest.  The Alabama School AED Law states the following:

"An automated external defibrillator shall be placed in each public K-12 school in Alabama. The superintendent of each local board of education shall designate at least one employee at each school to be trained in the use of an automated external defibrillator."

Even though the law states that only one employee at each school should be trained, it is always recommended to have more staff trained.  The more people that are trained on how to perform CPR effectively and how to utilize an AED during an emergency, the higher the percentage of survival rate a victim has. 

Schools receive limited budgets for the school year and have to strategically plan what items it will purchase for the year.  AEDs always seem to be the last on the list of needs.  With the new school AED law, the State of Alabama is requiring schools have AEDs available.  If your school district's budget is limited, then consider some fundraising ideas and grant options to purchase AEDs for the schools.   To view some fundraising ideas and grant programs, CLICK HERE.

Alabama AED Registration

BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH

 HOUSES THEREOF CONCURRING, That we hereby request that the

 Alabama Council of Emergency Medical Services and the Alabama

 Chapter of the American Heart Association contact the

 manufacturers of automated external defibrillators urging them

 to establish a registry of automated external defibrillators.

 BE IT FURTHER RESOLVED, That we urge that the

 manufacturers of such defibrillators to notify owners of

 automated external defibrillators that removal of the unit by

 the owner for any reason should be reported to the Alabama

 Council of Emergency Medical Services so that appropriate

 action can be taken with the local 911 center.
