California AED Law - Senate Bill 911 (SB 911)

The State of California has enacted an AED law that requires AED owners to follow certain rules and regulations to be protected from liability.  The California AED Law states the following:

"(b) In order to ensure public safety, any person who acquires an AED shall do all of the following:

(1) Comply with all regulations governing the training, use, and placement of an AED.

(2) Notify an agent of the local EMS agency of the existence, location, and type of AED acquired.

(3) Ensure all of the following:

(A) That expected AED users complete a training course in cardiopulmonary resuscitation and AED use that complies with regulations adopted by the Emergency Medical Services (EMS) Authority and the standards of the American Heart Association or the American Red Cross.

(B) That the defibrillator is maintained and regularly tested according to the operation and maintenance guidelines set forth by the manufacturer, the American Heart Association, and the American Red Cross, and according to any applicable rules and regulations set forth by the governmental authority under the federal Food and Drug Administration and any other applicable state and federal authority.

(C) That the AED is checked for readiness after each use and at least once every 30 days if the AED has not been used in the preceding 30 days. Records of these periodic checks shall be maintained.

(D) That any person who renders emergency care or treatment on a person in cardiac arrest by using an AED activates the emergency medical services system as soon as possible, and reports any use of the AED to the licensed physician and to the local EMS agency.

(E) That there is involvement of a licensed physician in developing a program to ensure compliance with regulations and requirements for training, notification, and maintenance."

California requires that any individual that is expected to use the AED should be trained in CPR and AED use.  Training prepares those individuals for an emergency and how to utilize the AED when necessary. 

A physician must be involved in the AED Program to ensure that the program is following all the rules and regulations set forth by the state and to ensure that the AED is properly maintained, the staff has been trained, and to report the AED to the local EMS.

California Good Samaritan Law - Senate Bill 911 (SB 911)

The State of California Good Samaritan Law protects individuals, who in good faith, aid a victim during an emergency from liability.  The California Good Samaritan Law states the following:

"This bill would provide immunity from civil liability to (1) any person who, in good faith and not for compensation renders emergency care or treatment by the use of an automated external defibrillator at the scene of an emergency, has completed a basic CPR and automated external defibrillator (AED) use course that complies with regulations adopted by the Emergency Medical Services (EMS) Authority and the standards of the American Heart Association or the American Red Cross for CPR and AED use, (2) a person or entity who provides CPR and AED training to a person who renders emergency care pursuant to (1), and (3) a physician who is involved with the placement of an AED and any person or entity responsible for the site where an AED is located if that physician, medical authority, person, or entity has complied with certain requirements. The bill would provide that its protections shall not apply in the case of personal injury or wrongful death that results from the gross negligence or willful or wanton misconduct of the person who renders emergency care or treatment by the use of an AED."

California Fitness Club AED Law - Senate Bill 127 (SB 127)

The State of California has enacted an AED law that requires fitness and health clubs to have an AED on site.  The California Fitness Club AED Law states the following:

"104113. (a) Every health studio, as defined in subdivision (h), shall acquire, maintain, and train personnel in the use of, an automatic external defibrillator pursuant to this section."

California AED EMS Registration Law - (AB2083)
 SECTION 1.  Section 1797.196 of the Health and Safety Code, as
amended by Section 1 of Chapter 111 of the Statutes of 2005, is
amended to read:
   1797.196.  (a) For purposes of this section, "AED" or
"defibrillator" means an automated or automatic external
defibrillator.
   (b) In order to ensure public safety, any person or entity that
acquires an AED is not liable for any civil damages resulting from
any acts or omissions in the rendering of the emergency care under
subdivision (b) of Section 1714.21 of the Civil Code, if that person
or entity does all of the following:
   (1) Complies with all regulations governing the placement of an
AED.
   (2) Ensures all of the following:

California AED State Buildings Law - (AB1145)
8455.  (a) The Department of General Services shall apply for
federal funds made available through the federal Community Access to
Emergency Devices Act (Public Law 107-188) for the purchase of
automated external defibrillators to be located within state-owned
and leased buildings.
   (b) Subject to the receipt of federal funds for this purpose, the
Department of General Services shall, in consultation with the
Emergency Medical Services Authority, the American Red Cross, and the
American Heart Association, develop and adopt policies and
procedures relative to the placement and use of automated external
defibrillators in state-owned and leased buildings and ensure that
training is consistent with Section 1797.196 of the Health and Safety
Code and the regulations adopted pursuant to that section.  In these
consultations, the department may consider all of the following:
   (1) Whether the public has access to the state-owned or leased
building.
   (2) Placement within the building that maximizes access to the
device.
   (3) The manufacturer's and the medical community's directions
regarding placement and use of the device.
   (4) The appropriate oversight and maintenance of the device at a
particular location.
   (5) Whether to require those who are trained to use the automated
external defibrillators pursuant to Emergency Medical Services
Authority standards to receive cardiopulmonary resuscitation
training.
   (c) The policies and procedures adopted pursuant to this section
shall be consistent with Section 3400 of Title 8 of the California
Code of Regulations.
  SEC. 3.  This act is an urgency statute necessary for the immediate
preservation of the public peace, health, or safety within the
meaning of Article IV of the Constitution and shall go into immediate
effect.  The facts constituting the necessity are:
   In order to provide immediate assistance to persons in state-owned
or state-leased buildings who might otherwise die or suffer severe
injury from cardiac arrest, at the earliest possible time, it is
necessary that this act take effect immediately.

California Adult Residential Facility AED Law -Senate Bill
 
SECTION 1. Section 1507.3 of the Health and Safety Code is amended to read: 1507.3. (a) A residential facility that provides care to adults may obtain a waiver from the department for the purpose of allowing a resident who has been diagnosed as terminally ill by his or her physician or surgeon to remain in the facility, or allowing a person who has been diagnosed as terminally ill by his or her physician and surgeon to become a resident of the facility if that person is already receiving hospice services and would continue to receive hospice services without disruption if he or she became a resident, when all of the following conditions are met:
