Maine AED Law

The State of Maine AED Law has been created to protect individuals and organizations that own AEDs from liability.  The Maine AED Law states the following:

"1. Training and maintenance. A person who possesses an automated external defibrillator must:

A. Require expected users to complete successfully a course in automated external defibrillation and cardiopulmonary resuscitation that is offered or approved by the American Heart Association or another nationally recognized organization;

B. Maintain and test the defibrillator according to the manufacturer's guidelines; and

C. Consult with a physician regarding compliance with the requirements of paragraphs A and B.

2. Notification of location of defibrillator. A person in possession of an automated external defibrillator shall notify an agent of the local emergency communications or vehicle dispatch center of the existence, location and type of the automated external defibrillator.

3. Authorized users. A person who has obtained appropriate training on how to perform automated external defibrillation and has successfully completed a course in cardiopulmonary resuscitation may perform automated external defibrillation, regardless of whether the person is a physician, registered nurse, licensed practical nurse or emergency medical services provider.

4. Activation of emergency medical services system. A person who renders out-of-hospital emergency care or treatment to a person in cardiac arrest by using an automated external defibrillator must activate the emergency medical services system as soon as possible and report any clinical use of the automated external defibrillator."

Maine requires that the owners of an AED must train individuals in CPR and AED use that will most likely use the AED and the AED must be maintained according to the manufacture's guidelines.  The local EMS must be notified of the AED placement.

Maine Good Samaritan Law

The State of Maine has enacted a Good Samaritan Law that protects individuals and organizations that aid a victim during an emergency.  The Maine Good Samaritan Law states the following:

"3. Immunity for providing defibrillation. Except in the case of intentional misconduct or when there is no good faith attempt to notify an emergency medical services system organization in accordance with section 2150-D, subsection 3, a person is not criminally responsible nor liable for civil damages for injury, death or loss to person or property for performing automated external defibrillation in good faith, regardless of whether the person has obtained appropriate training on how to perform automated external defibrillation."

Maine Health Club Law LD 1073

Sec. 1 Department of Public Safety to work with health clubs and gyms. Resolved: That the Department of Public Safety shall work with the Department of Health and Human Services, Maine Center for Disease Control and Prevention, Maine Cardiovascular Health Program and the American Heart Association's Maine affiliate and request the assistance of emergency medical services around the State to determine where health clubs and gyms are located, whether automated external defibrillators, referred to in this resolve as "AEDs," are installed in those health clubs and gyms and whether health club and gym staff are trained in the use of AEDs. Information relating to the extension of the government discounted price for AEDs to health clubs and gyms to encourage the purchase of AEDs must be included in the work of the Department of Public Safety and must be publicized to health clubs and gyms; and be it further

 

Sec. 2 Report. Resolved: That, by January 1, 2012, the Department of Public Safety shall provide a progress report to the Joint Standing Committee on Health and Human Services regarding the progress made by the department pursuant to section 1.

Maine AEDs for Extracurricular Activities Law (LD 1785)
Be it enacted by the People of the State of Maine as follows:

Sec. 1. 20-A MRSA §6304  is enacted to read:

§ 6304.   Automated external defibrillators and cardiopulmonary resuscitation

School boards may place automated external defibrillators in occupied school buildings and at school athletic events. School personnel and members of the public may receive training on how to perform cardiopulmonary resuscitation and use automated external defibrillators in order to acquire the skills and confidence to respond to emergencies.

 

Sec. 2. 22 MRSA §2150-C,  as enacted by PL 2001, c. 364, §1, is repealed and the following enacted in its place:

§ 2150-C.   Automated external defibrillators; immunity from civil liability

1 Definitions.   As used in this section, unless the context otherwise indicates, the following terms have the following meanings.
A "Automated external defibrillator" or "AED" means a medical device that combines a heart monitor and a defibrillator approved by the United States Food and Drug Administration that:

(1) Is capable of recognizing the presence or absence of ventricular fibrillation or rapid ventricular tachycardia;

(2) Is capable of determining, without intervention by an operator, whether defibrillation should be performed on an individual; and

(3) Upon determination that defibrillation should be performed, automatically charges and requests delivery of an electrical impulse to an individual's heart.

6 Immunity.   The following persons and entities are immune from civil liability for damages relating to the use, possession or purchase of an AED and arising out of acts or omissions relating to preparing for and responding to suspected sudden cardiac arrest emergencies absent gross negligence or willful or wanton misconduct:
A Any person or entity that acquires an AED;
B Any person or entity that owns, manages or is otherwise responsible for the premises on which an AED is located;
C Any person who retrieves an AED in response to a perceived sudden cardiac arrest emergency;
D Any person who uses, attempts to use or fails to use an AED in response to a perceived sudden cardiac arrest emergency;
E Any physician or other authorized person who issues a prescription for the purchase of an AED;
F Any person or entity that is involved with the design, management or operation of an AED program; and
G Any person or entity that provides instruction in the use of an AED.
