Texas AED Law - Senate Bill 580 (SB 580)

The State of Texas has instituted an AED Law that has certain requirements for owners of an AED to follow.  The Texas AED law states the following: 

"Sec. 779.002. TRAINING. (a) A person or entity that acquires an automated external defibrillator shall ensure that:

(1) each user of the automated external defibrillator receives training given or approved by the Texas Department of Health in:

(A) cardiopulmonary resuscitation; and

(B) use of the automated external defibrillator; and

(2) a licensed physician is involved in the training program to ensure compliance with the requirements of this chapter.

(b) The Texas Department of Health shall adopt rules establishing the minimum requirements for the training required by this section. In adopting rules under this section, the Texas Department of Health shall consider the guidelines for automated external defibrillator training approved by the American Heart Association, the American Red Cross, or another nationally recognized association.

Sec. 779.003. MAINTENANCE OF AUTOMATED EXTERNAL

DEFIBRILLATOR. A person or entity that owns or leases an automated external defibrillator shall maintain and test the automated external defibrillator according to the manufacturer's guidelines.

Sec. 779.004. USING AN AUTOMATED EXTERNAL DEFIBRILLATOR. A person or entity that provides emergency care to a person in cardiac arrest by using an automated external defibrillator shall promptly notify the local emergency medical services provider.

Sec. 779.005. NOTIFYING LOCAL EMERGENCY MEDICAL SERVICES PROVIDER. When a person or entity acquires an automated external defibrillator, the person or entity shall notify the local emergency medical services provider of the existence, location, and type of automated external defibrillator."

The State of Texas requires that an organization's staff be trained in an approved training course by the American Heart Association, American Red Cross, or another nationally recognized training association.  Texas also requires the medical oversight of a physician for the CPR Training program.  This means that your organization much have a physician oversee your CPR Training program, so that he or she can make sure that all the necessary steps are being completed.

Texas requires every organization and individual to properly maintain the AED by replacing the pads and batteries according to the manufacture's guidelines.  Each manufacture has different expiration dates and those expiration dates can be found in the user's manual for the AED.

The owner of the AED must notify local EMS of the placement of the AED.  And if the AED is in use, then a call must be placed to 911 immediately.

Texas Good Samaritan Law

The Texas Good Samaritan Law has been enacted to protect individuals that aid during an emergency in good faith to rescue a victim.  The State of Texas Good Samaritan Law states the following:

"UNLICENSED MEDICAL PERSONNEL.
Persons not licensed in the healing arts who in good faith administer emergency care as emergency medical service personnel are not liable in civil damages for an act performed in administering the care unless the act is willfully or wantonly negligent. This section applies without regard to whether the care is provided for or in expectation of remuneration."

Texas AED Requirement Law- House Bill 92 (HB92)

 

              AN ACT

                relating to the acquisition of certain automated external

                defibrillators.

                       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

                 SECTION 1.  Section 779.007, Health and Safety Code, is

                amended to read as follows:

                       Sec. 779.007.  POSSESSION OF AUTOMATED EXTERNAL

                DEFIBRILLATORS.  Each person or entity, other than a licensed

                practitioner, that acquires an automated external defibrillator

                that has not been approved by the United States Food and Drug

                Administration for over-the-counter sale shall ensure that:

                             (1)  the automated external defibrillator has been

                delivered to that person or entity by a licensed practitioner in the

                course of his professional practice or upon a prescription or other

                order lawfully issued in the course of his professional practice;

                or

                             (2)  if the automated external defibrillator is

                acquired for the purpose of sale or lease, the person or entity

                shall be in conformance with the applicable requirements found in

                Section 483.041, Health and Safety Code.

                       SECTION 2.  This Act takes effect immediately if it receives

                a vote of two-thirds of all the members elected to each house, as

                provided by Section 39, Article III, Texas Constitution.  If this

Act does not receive the vote necessary for immediate effect, this

               

 

     Act takes effect September 1, 2007.

Texas AED Extracurricular Law- Senate Bill 82 (SB82)

    SECTION 1.  Chapter 33, Education Code, is amended by adding

Subchapter F to read as follows:

SUBCHAPTER F.  SAFETY REGULATIONS FOR CERTAIN

EXTRACURRICULAR ACTIVITIES

       Sec. 33.201.  APPLICABILITY.  This subchapter applies to

each public school in this state and to any other school in this

state subject to University Interscholastic League rules.

       Sec. 33.202.  SAFETY TRAINING REQUIRED. (a)  The

commissioner by rule shall develop and adopt an extracurricular

activity safety training program as provided by this section. In

developing the program, the commissioner may use materials

available from the American Red Cross, Emergency Medical Systems

 

(EMS), or another appropriate entity.

Texas AED Nursing Home Law- House Bill 392 (HB392)

               

AN ACT

                relating to the availability and use of automated external

                defibrillators in nursing homes and related institutions.

                       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

                       SECTION 1.  Subchapter F, Chapter 242, Health and Safety

                Code, is amended by adding Section 242.159 to read as follows:

                       Sec. 242.159.  AUTOMATED EXTERNAL DEFIBRILLATORS. (a)  An

                institution shall have available for use at the institution an

                automated external defibrillator, as defined by Section 779.001,

                and shall comply with the training, use, and notification

               requirements of Chapter 779.
